Terms of Service & Acceptable Use Policy

1. Binding Agreement & Eligibility

By accessing, browsing, or using Crematic ("the Service", "we", "us", or "our"), you enter into a legally binding agreement and agree to comply with and be bound by these Terms of Service. If you do not agree to these Terms, you must immediately cease using the Service. You must be at least 18 years of age or the legal age of majority in your jurisdiction to use this Service.

2. Proprietary Rights & Anti-Theft Protections

All software, source code, visual designs, audio engineering workflows, user interfaces, scripts, and documentation comprising Crematic are the exclusive proprietary property of Crematic and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to use the interface solely for personal or authorized speech generation.

Strict Restrictions: You shall not copy, duplicate, reverse engineer, decompile, disassemble, scrape, redistribute, license, sublicense, sell, or create derivative works of any portion of Crematic's proprietary code or interface without express prior written consent.

3. Acceptable Use & AI Ethics Policy

Crematic provides high-fidelity neural speech synthesis. You are solely and fully responsible for any text you input and any audio you generate, synthesize, or distribute. You strictly agree NOT to use the Service for:

• Non-Consensual Impersonation & Deepfakes: Synthesizing the voice or likeness of real living individuals, celebrities, public figures, or private citizens without their explicit, verifiable written authorization.
• Fraud, Scams & Deception: Creating deceptive audio intended for vishing (voice phishing), telemarketing scams, unauthorized emergency calls, or financial deception.
• Elections & Disinformation: Falsifying statements by government officials, candidates, political parties, or manipulating public election integrity.
• Harassment & Harm: Generating hate speech, defamatory material, threats of violence, stalking, intimidation, or explicit non-consensual content.
• Copyright Infringement: Inputting copyrighted or proprietary text for which you do not possess valid distribution rights.

4. User Content & Ownership of Audio Output

You retain all ownership rights in the text prompts you provide. You represent and warrant that you hold all necessary licenses, permissions, and intellectual property rights in your input text. You assume all legal and financial liability for any audio produced, saved, or distributed from your use of the Service.

5. Disclaimer of Warranties ("AS IS")

THE SERVICE AND ALL SYNTHESIZED AUDIO ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT INFERENCE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH EVERY BROWSER OR HARDWARE ACCELERATOR.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CREMATIC, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, REPUTATIONAL HARM, LOSS OF DATA, OR LEGAL DISPUTES ARISING FROM YOUR USE OF THE SERVICE OR ANY GENERATED AUDIO, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00).

7. Indemnification

You agree to defend, indemnify, and hold harmless Crematic and its authors, contributors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorney fees) arising out of or relating to: (a) your violation of these Terms; (b) the text you input or audio you synthesize; (c) your infringement of any third-party intellectual property or privacy rights; or (d) any unlawful use of generated audio.

8. DMCA & Copyright Infringement Notices

Because Crematic executes neural inference 100% locally in user browsers without retaining text or audio on servers, we do not host user audio. If you believe intellectual property belonging to you has been infringed on this site, contact us with relevant documentation for investigation.

9. Modifications & Severability

We reserve the right to revise these Terms at any time. Continued use of the Service constitutes agreement to any updated terms. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
